CHEYENNE, Wyo. (AP) – A train conductor is suing Union Pacific Railroad Co. arguing that the company’s negligence and safety violations led to him being thrown from a rail car in a Cheyenne train yard and losing part of his foot.
Jeremy F. Givens filed the lawsuit in Laramie County District Court on April 8.
The lawsuit said Givens suffered “traumatic amputation” of part of his right foot on Oct. 30, 2014.
The complaint argues Union Pacific failed to provide safe tools and equipment and violated the Federal Employers’ Liability Act. Givens is seeking compensation for medical expenses, pain, loss of income and permanent injury and disability.
Union Pacific has not filed its response. A company spokeswoman did not immediately respond to a request for comment Monday morning.
